Guide to Asbestos Legislation – Northern Ireland & Ireland
Asbestos is controlled by separate regulatory frameworks in Northern Ireland and the Republic of Ireland. While the principles of asbestos safety are similar, the legal duties differ and must be addressed correctly.
Northern Ireland – Control of Asbestos Regulations 2012
In Northern Ireland, asbestos is regulated under the Control of Asbestos Regulations (Northern Ireland) 2012. These regulations place duties on those responsible for non-domestic premises to identify, manage and control asbestos risks.
Republic of Ireland – Asbestos Regulations
In the Republic of Ireland, asbestos is governed by the Safety, Health and Welfare at Work (Exposure to Asbestos) Regulations and related legislation. These regulations set out employer duties for risk assessment, exposure control and safe removal of asbestos.
Key Responsibilities Across Both Jurisdictions:
- Identify asbestos-containing materials
- Assess risk and prevent exposure
- Maintain appropriate records and documentation
- Ensure safe working practices during maintenance or construction
- Use competent contractors for asbestos removal and disposal
Asbestos does not always require removal. Where materials are in good condition and not disturbed, they may remain in place provided they are properly managed and monitored in line with the relevant regulations.
